THE LUXURY BROKERS TERMS OF MEMBERSHIP

 

OBLIGATIONS

 

1.    The payment of monthly membership fees (when applicable).

2.    The payment of fee related to any service rendered by The Luxury Brokers (when applicable).

3.    Display The Luxury Brokers logo on appropriate marketing materials, advertising, and on web sites.

4.    Post your property listings to TheLuxuryBrokers.com, and update the listings when changes occur.

 

 

TERMS

 

1.    Paying membership fees or service fees will be deemed acceptance of these terms.

2.    This is a month-to-month agreement.

3.    The membership and this agreement will automatically renew each month. This document will be the agreement between The Luxury Brokers, LLC. and Member, unless revised and posted online at http://theluxurybrokers.com/membership_agreement.htm website.

4.    Upon renewal, Member understands actual membership fee is due upon each monthly renewal.

5.    Renewal rates may be affected by the cost fluctuations and program changes.

6.    Membership fees are non-refundable once credit card has been billed.

7.    Member has the right to unsubscribe from any membership at anytime for any reason without penalty, fee, cost, or further obligation whatsoever.

8.    The Luxury Brokers, LLC. holds the right to cancel this agreement and revoke membership services at anytime for any reason. Member?s only recourse is the refund of the current month?s membership fee, prorated for the amount of the days left on the one month agreement.

9.    Member agrees to exercise maximum caution when using and storing ?Millionaire Contacts? information and because of the nature of the information membership fees are non-refundable.

10.  If a member receives a free membership offer via a promotional service, the service fee is non refundable.

11.  (Members  or non-members) All advertising fees are non-refundable. This includes video broadcasting fees, video production fees, and art service fees.

12.  Member agrees not to sell or distribute in anyway any material accessed by membership, to include all business tools, databases, and proprietary information. 

13.  Member agrees that The Luxury Brokers, LLC. may remove some or all of Member?s presence on www.TheLuxuryBrokers.com if member falls 90+ days past due for any invoice from The Luxury Brokers, LLC.

14.  Member?s presence on the website will be restored when the account is paid in full.

15.  Member understands by posting their listings to www.TheLuxuryBrokers.com, they are allowing The Luxury Brokers, LLC. to promote property listings in various mediums including but not limited to TheLuxuryBrokers.com, even after member cancels membership these efforts may continue. 

16.  Member agrees that The Luxury Brokers, LLC. has not made any representations or agreements to induce it to enter this agreement.

17.  No representations have been made concerning the level of media exposure, referrals, business or profits that Member might reasonably expect, which are dependent upon variables beyond The Luxury Brokers, LLC. control, including the ability, motivation, and amount and quality of effort expended by Member. The Luxury Brokers, LLC. has made no representation that it will provide a marketing plan for Member.

18.  Member has no expectation that referrals from TheLuxuryBrokers.com will exceed in any number during the Term of this agreement.

19.  Member represents that it is an experienced licensed salesperson, agent or broker of luxury property, and provides the highest level of personal service and commitment to its clientele, and will continue to do so during the term of this agreement to all clients, including those referred through TheLuxuryBrokers.com

20.  Member will take full responsibility for the conduct of its own business, and will set its own fees, and will not be given any training or assistance or marketing plan.

21.  Member is an independent business. Member and The Luxury Brokers, LLC. are not agents, partners, joint ventures, beneficiaries or fiduciaries, of one another; and neither party will be bound or obligated by the other.

22.  Member will not permit the public to confuse it with The Luxury Brokers, LLC. or it?s website TheLuxuryBrokers.com. Member will not permit to become substantially associated with TheLuxuryBrokers.com trademarks, and will more prominently display it?s own trade name or trademark than any trademark of TheLuxuryBrokers.com. Member will follow The Luxury Brokers, LLC. directions as to how to display TheLuxuryBrokers.com trademarks.

23.  Other than preexisting marks that member disclosed to The Luxury Brokers, LLC. prior to paying membership fees, Member?s own trademark, trade name, and/or business name, cannot have any elements similar to any of those of TheLuxuryBrokers.com. This includes, but is not limited to, the lion and eagle coat-of-arms and or the use of the words ?luxury? and ?luxury brokers?.

24.  Member agrees to indemnify The Luxury Brokers, LLC, it?s website, and any of its agents and employees from any claim or demand made by any third party arising from Member?s conduct.

25.  This agreement is governed by the laws of the state of Colorado, and jurisdiction will be in the state of Colorado.

26.  If any section of the agreement becomes void, the other sections shall remain.

27.  The failure of either party to enforce any part of this Agreement shall not prevent a party from enforcing that part of the agreement for a subsequent act.

28.  Member is responsible to frequently review this membership agreement for any changes.
